Introduction
This purchase is governed by the standard terms and conditions below for consumer purchases of goods over the Internet. Consumer purchases over the Internet are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Act, the Right of Withdrawal Act, and the E-Commerce Act. These laws provide the consumer with non-derogable rights. The laws are available at www.lovdata.no. The terms in this agreement shall not be construed as limiting statutory rights but set out the parties’ main rights and obligations concerning the transaction.

The terms and conditions have been prepared and recommended by the Norwegian Consumer Authority. For a better understanding of these terms, see the Consumer Authority’s guide here.

1. Agreement
The agreement consists of these terms and conditions, information provided in the ordering system, and any separately agreed terms. In the event of conflict between the information, the specially agreed terms between the parties shall prevail, provided they do not violate mandatory law.

The agreement is further supplemented by relevant statutory provisions regulating purchases of goods between businesses and consumers.

2. The Parties
The seller is Traadtulla Design, hereinafter referred to as the seller. Contact details are as follows:

Organization number: 931 234 668
Address: Liomveien 29, 1362 Hosle, Norway
Email: [email protected]

The buyer is the consumer placing the order and is hereinafter referred to as the buyer.

3. Price
The stated price for the goods and services is the total amount the buyer shall pay. This price includes all taxes and additional costs. Additional costs not disclosed by the seller prior to purchase shall not be borne by the buyer.

4. Conclusion of Agreement
The agreement is binding for both parties once the buyer has submitted the order to the seller.

However, the agreement is not binding if a typographical or input error occurred in the seller’s offer in the online ordering system or in the buyer’s order, and the other party knew or should have known of such an error.

5. Payment
The seller may demand payment for the goods from the moment the goods are shipped from the seller to the buyer.

If the buyer pays by credit or debit card, the seller may reserve the purchase amount on the card upon ordering. The card will be charged on the day the goods are shipped.

For payment by invoice, the invoice is issued to the buyer upon shipment of the goods. The payment deadline is stated on the invoice and is at least 14 days from receipt.

Buyers under 18 years of age cannot pay by invoice.

6. Delivery
Delivery is considered completed when the buyer or their representative has taken possession of the goods.

Orders are processed within 1-3 business days. Deviations may occur.

If no delivery date is specified in the ordering system, the seller shall deliver the goods to the buyer without undue delay and no later than 30 days after the buyer’s order. Unless otherwise agreed, the goods shall be delivered to the buyer’s address.

7. Risk of the Goods
Risk passes to the buyer when they or their representative have received the goods in accordance with section 6.

8. Right of Withdrawal
Unless the agreement is exempt from the right of withdrawal, the buyer may withdraw from the purchase pursuant to the Right of Withdrawal Act.

The buyer must notify the seller of their decision to withdraw within 14 days from when the withdrawal period begins. All calendar days are included. If the deadline falls on a Saturday, public holiday, or holiday, it is extended to the next business day.

The withdrawal period is deemed met if the notification is sent before the deadline expires. The buyer bears the burden of proof that the right of withdrawal has been exercised and should notify the seller in writing (withdrawal form, email, or letter).

The withdrawal period begins:

  • For single goods, from the day after the goods are received.

  • For subscriptions or contracts involving regular delivery of identical goods, from the day after the first shipment is received.

  • For multiple deliveries, from the day after the last shipment is received.

The withdrawal period is extended to 12 months after the original deadline if the seller did not provide information about the right of withdrawal and the standardized withdrawal form before the contract was concluded. The same applies if information about terms, deadlines, and procedures for exercising the right of withdrawal is missing. If the seller provides this information within the 12 months, the withdrawal period expires 14 days after the buyer receives the information.

Upon withdrawal, the goods must be returned to the seller without undue delay and no later than 14 days after notification of withdrawal. The buyer covers the direct costs of returning the goods, unless otherwise agreed or the seller failed to inform the buyer that they bear the return costs. The seller cannot impose a fee for the buyer’s use of the right of withdrawal.

The buyer may test or try the goods as necessary to determine their nature, properties, and functioning without losing the right of withdrawal. If the testing exceeds what is necessary, the buyer may be liable for any reduced value of the goods.

The seller shall refund the purchase price without undue delay and no later than 14 days after notification of the buyer’s withdrawal. The seller may withhold the refund until receiving the goods or until the buyer provides proof that the goods have been sent back.

9. Delay and Non-Delivery – Buyer’s Rights and Deadline for Claims
If the seller does not deliver or delivers late according to the agreement and this is not due to the buyer, the buyer may, under the Consumer Purchases Act Chapter 5, withhold payment, demand performance, cancel the contract, and/or claim damages from the seller.

Claims should be notified in writing (e.g., email) for evidence purposes.

Performance:
The buyer may insist on performance and demand delivery from the seller, unless there is an obstacle the seller cannot overcome or the performance would cause unreasonable inconvenience or costs to the seller.

Cancellation:
If the seller fails to deliver on time, the buyer shall grant a reasonable additional deadline. If the seller does not deliver within that time, the buyer may cancel the purchase. Immediate cancellation is allowed if the seller refuses delivery or if timely delivery was essential to the agreement.

Claims must be made within a reasonable time after the buyer became aware of delivery after the additional deadline.

Damages:
The buyer may claim compensation for losses due to delay unless the seller proves the delay was due to an obstacle beyond their control.

10. Defects in the Goods – Buyer’s Rights and Complaints Period
If the goods have defects, the buyer must notify the seller within a reasonable time after discovering the defect, but no later than 2 months after. Complaints must be made within 2 or 5 years depending on the expected lifespan of the goods.

If the defect is not due to the buyer, the buyer may, under the Consumer Purchases Act Chapter 6, withhold payment, demand repair or replacement, claim a price reduction, cancel the contract, and/or seek damages.

Complaints should be in writing.

Repair or Replacement:
The buyer may choose repair or replacement. The seller may refuse if this is impossible or unreasonable.

Price Reduction:
The buyer may demand an appropriate price reduction if repair or replacement is not made.

Cancellation:
The buyer may cancel the purchase if the defect is not insignificant and the defect is not repaired or replaced.

11. Seller’s Rights in Case of Buyer’s Breach
If the buyer fails to pay or fulfill obligations, the seller may withhold delivery, demand performance, cancel the contract, and/or claim damages, including interest, collection fees, and fees for uncollected goods.

12. Warranty
Any warranty from the seller or manufacturer gives additional rights beyond statutory rights and does not limit the buyer’s claims under sections 9 and 10.

13. Personal Data
The seller is responsible for processing personal data. Data collected is necessary to fulfill the contract. Personal data will only be shared if necessary to fulfill the agreement or required by law.

14. Dispute Resolution
Complaints should be directed to the seller within a reasonable time. Parties shall attempt amicable resolution. If unsuccessful, the buyer may contact the Norwegian Consumer Authority for mediation at +47 23 400 600 or www.forbrukertilsynet.no.

EU consumers may use the EU Online Dispute Resolution platform at http://ec.europa.eu/odr.
